We at Pat Summitt Leadership Group and the Southwestern Family of Companies respect your privacy. This Privacy Policy pertains to Southwestern/Great American, Inc. and its related entities and their divisions which do not have their own particular Privacy Policy unique to them, now and as they form in the future (collectively “Southwestern”, “we”, “us”, or “our”) and informs our users (“user(s)”, “you”, or “your”) about how Southwestern may collect and use the personal information that you provide on our websites (our “Sites”), the manner in which we may use such information, how we protect it, and the choices available to you regarding our use of your personal information. 

We may modify or supplement this Privacy Policy from time to time by posting those changes on this page. Any changes will become effective as of the date of posting. Please review this Privacy Policy often so you are always fully informed of any changes. 

In some cases, our users may include students under the age of thirteen (13) and/or the parents or guardians of those students. For more information on the Children’s Online Privacy Protection Act (“COPPA”) and how Southwestern complies with children’s data protection regulations, please read the section titled  Children’s Data Protection and Parental Responsibility below. 

This Privacy Policy is binding on all those who access, visit, and/or use our Sites and the services associated with the Sites (collectively, the “Services”), whether acting as an individual or on behalf of an entity, including you and all persons, entities, or digital engines of any kind that harvest, crawl, index, scrape, spider, or mine digital content by an automated or manual process or otherwise. If you do not agree to be bound by this Privacy Policy, then do not access or use the Services. By accessing and/or using the Services, you accept and agree to be bound by this Privacy Policy and our Terms of Use, which are hereby incorporated by reference.

SOUTHWESTERN MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND REGARDING USE OF THIS SITE OUTSIDE OF THE UNITED STATES AND CANADA. Those who access our Site(s) from other jurisdictions are responsible for their compliance with local laws pertaining to the use of our Site(s).

Collection and Retention of Information 

When you visit our Sites, whether to request merchandise and services or simply to become better acquainted with Southwestern’s various offerings, we may ask you to provide certain information about yourself, including your name, mailing address, email address, and phone number. In addition, purchases by credit card will require your disclosure of your credit card account number and security number for that credit card. In other instances, we (or qualified contractors/vendors on our behalf) may automatically collect some non-personally identifiable computer information regarding your use of our Sites, such as the type of computer operating system you are using (such as Windows 8, Mac OS, etc.) and web browser that you are using (such as Internet Explorer, Safari, etc.), as well as information regarding your Internet service provider, IP address, and the frequency with which you visit various parts of our web sites. 

We may use cookies to identify you when you visit us and to keep track of where you go so we can provide you with more personalized service by way of our Sites. A “cookie” is a small piece of information that we may place in your computer browser to collect information regarding your preferences. Cookies do not contain any personally identifiable information. You can use your browser settings to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. If you turn off cookies, you will not have access to some of the features on our Sites, and some of our services may not function properly. 

We may also request your username, email address and telephone number if you submit a form through the “Contact Us” portion of our web site so that we may respond to the inquiry. We collect the email content, email address and phone number for the sole purpose of responding directly on a onetime basis to a specific inquiry. We may retain this information for customer service purposes.  When you order online or subscribe to any of our Sites, we may ask you to provide certain information about yourself to facilitate the transaction. This information may include your first and last name, username, password, mailing address, e-mail address, telephone number, and payment information. In connection with online subscriptions or purchases, we collect personallyidentifiable financial information. Credit card or account billing information, including mailing addresses, are collected at the time of purchase. Southwestern will store this information only if necessary and will do so in accordance with Payment Card Industry standards. 

In addition, such necessary information may be stored by our payments processing vendor(s) for the purpose of processing payments, collection efforts, and for fraud prevention purposes. Our payments processing vendor has agreed to maintain the confidentiality, security, and integrity of the personal and financial information it obtains from our Sites and to use this information solely on our behalf for the legitimate purposes outlined above. Our payment processing vendor is bound by all applicable privacy laws relating to the provision of financial services. 

Southwestern may, from time to time, offer forums or the ability to comment through some of our Sites. If you post personally identifiable information on a forum, you should be aware that such information could be read, collected or used by other users. We are not responsible for any personallyidentifiable information you choose to publish through such forums. These forums are intended for use only by users over the age of thirteen (13) years. 

If you use Google™  , Facebook™ , or similar social media connect functions to log in, we may collect your name and email address to authenticate you and your profile picture to use as your picture on our applicable web site. Your decision to use a social networking service in connection with our Services is voluntary. However, you should make sure you are comfortable with the information your third-party social networking services may make available to our Services by visiting those services’ privacy policies and/or modifying your privacy settings directly with those services. THIS FEATURE IS INTENDED ONLY FOR USERS OVER THE AGE OF THIRTEEN (13) YEARS. 

Children’s Data Protection and Parental Responsibility 

As part of our Services, Southwestern makes available subscription sites and online stores that may be of interest to children. WE DO NOT ALLOW CHILDREN TO REGISTER THEMSELVES FOR THESE SERVICES AND WILL NEVER ASK CHILDREN UNDER THIRTEEN (13) TO DIRECTLY PROVIDE PERSONAL INFORMATION, NOR DO WE INTEND THAT THE SERVICES BE UTILIZED BY CHILDREN UNDER THIRTEEN (13) WITHOUT ADULT SUPERVISION. It is solely responsibility of the child’s parent(s) or lawful guardian(s) to provide Southwestern with personal information that we may store and use about their children in registering and maintaining accounts on our Sites. Southwestern will never receive or accept personally identifiable information about a child from any school or educational institution with which we may be partnered. 

When we collect personal information pertaining to children under thirteen (13) years old, we take steps to protect children’s privacy, including: 

In accordance with applicable law and our practices, obtaining confirmation regarding the child’s age and verifiable consent from parents/guardians prior to our collection, use, or disclosure of any personal information about children under thirteen (13) by sending a confirmation email to the email address of the parent or guardian registering the child; 

Limiting our collection of personal information from children to no more than is reasonably necessary to participate in an online activity; 

Giving parents/guardians the ability to request access to personal information that we have collected from their children and the ability to request that such personal information be changed or deleted; and 

Keeping this Privacy Policy updated so that parents/guardians can read about our information practices regarding children’s information, what we collect and how. 

We strongly advise children and parents to never provide any personal information in their usernames. 

Parents may at any time contact us at the contact information below to request a copy of the personal information that we have stored pertaining to their children and may withdraw their consent to our usage of such information and/or the deletion of such information at any time. To register children for our Services, parents may be asked to provide correct information about their children, including the child’s name, email address, username, age, telephone number and password, if necessary to gain access to the subscribed Service. IT IS SOLELY THE RESPONSIBILITY OF PARENTS AND/OR GUARDIANS TO MONITOR AND MANAGE THEIR CHILDREN’S USE OF OUR SERVICES. 

As with all of our users of any age, we will never require a child to disclosure more personal information than is reasonably necessary to participate in our Services and we do not retain any personal information for any user longer than is required to fulfill the purposes for which the personal information was supplied to us. We will never sell, share, or rent children’s data to any third parties. AT NO TIME WILL WE EVER SOLICIT OR KNOWINGLY ACCEPT PERSONALLY IDENTIFIABLE INFORMATION DIRECTLY FROM A CHILD OR STUDENT UNDER THIRTEEN (13) YEARS OLD. 

Our Use and Disclosure of Information 

Southwestern may use your personally identifiable information (email address, telephone number, etc.) to process orders, follow up with customer service, monitor your subscription, pursue collection activities, and market our products and Services (where you have not expressed a preference otherwise). We may share the information that we collect as necessary with our third-party agents or contractors, who assist in providing support for our internal operations and with whom we have obtained contractual confidentiality obligations regarding user information and, unless you have withdrawn your consent to such sharing or have expressed a preference otherwise, with our corporate affiliates if your purchasing history and/or interaction with us indicates that you may be interested in the products and/or services of those affiliates. We will not share any payment information that we have collected from you with our corporate affiliates and will restrict any such information sharing only to contact information where you have not expressed a preference otherwise. 

We also may use this information to notify you of new or special programs, prizes, and offerings of Southwestern. If you do not want any such updates, either by email or text, simply opt out of those communications by sending an email to that effect to our privacy-related email address [email protected], 2451 Atrium Way, Nashville, Tennessee 37214, indicating “Privacy Opt Out” in the subject line. Please allow up to 21 days for the opt out to take effect. In certain jurisdictions, such as Canada, you will only receive these communications if you have either expressly chosen to receive them or if you have completed a transaction with us. In such jurisdictions, if you opt-in to receiving such communications from us and our partners and later decide that you no longer wish to receive them, you may opt-out any time by selecting the “unsubscribe” option at the bottom of the email or by contacting us at  [email protected] in which event your opt-out will be processed within ten (10) days. 

 

Further use of the information we collect in the aggregate may involve statistical analysis of Site usage, our customers’ purchases, and the popularity of certain programs, prizes and offerings of Southwestern. Statistical analysis is generally done in the aggregate and will not be associated with any individual, but we may from time to time track this information on an individual basis for the purposes detailed above. 

We may use email addresses and usernames to track usage and to ensure users are following our Terms of Use. In addition, we may use an email address, username, or IP address to ban a user temporarily or permanently from any Site that the user engages in any inappropriate manner. WE RESERVE THE RIGHT TO TEMPORARILY OR PERMANENTLY BAN ANY USER AT ANY TIME WHO VIOLATES OUR TERMS OF USE.

We may, within our corporate discretion, process your orders and collect and store personally identifiable information using encryption technology. When employed, encryption allows you and us to input before encrypted information is sent via the Internet. We make commercially reasonable efforts intended to ensure that the personally-identifiable information we collect on our Site(s) is secured against unauthorized access.

The deletion or cessation of collection of information may result in cancellation of programs and subscriptions or other services initially provided to you. Please allow us up to 21 days from the date of our receipt of your request for any such deletion to take effect.
